Key provisions of Online Gaming Bill 2025

WHAT?

 

A new bill is presented in the parliament to regulate the online gaming in India involving financial transactions. The bill is titled Promotion and Regulation of Online Gaming Bill, 2025. It is a landmark legislation in India aimed at regulating the rapidly growing online gaming sector. Introduced and passed by the Lok Sabha on August 20, 2025, and by the Rajya Sabha on August 21, 2025, the bill seeks to promote beneficial forms of gaming like e-sports and social games while imposing a complete ban on real-money games (RMG) to address issues such as addiction, financial fraud, money laundering, and social harms. It extends across India and applies to offshore platforms targeting Indian users, with enforcement expected soon after presidential assent. 

 

The bill categorizes online gaming into segments: e-sports (competitive skill-based games), educational and social games (non-monetary), and online money games (involving stakes, banned).  It reflects the government's commitment to fostering innovation, protecting youth and vulnerable groups, and ensuring national security, amid reports of 32 suicides linked to RMG in the past 31 months and concerns over financial distress in families. 

 

Key Provisions

 

  1. Ban on Real-Money Games (RMG): Complete prohibition on offering, operating, facilitating, or promoting online games involving real money, regardless of whether they are based on skill (e.g., fantasy sports like Dream11, poker, rummy) or chance.  It includes banning advertisements, endorsements (including by celebrities), and any indirect promotion of RMG platforms. 
  2. Financial restrictions: Banks, payment intermediaries, and institutions are barred from processing transactions related to RMG, effectively cutting off funding. Existing RMG platforms will be blocked under the Information Technology Act, 2000. 
  3. Promotion of E-Sports and Social Games: E-sports are recognized as a legitimate competitive sport, with support from the Ministry of Youth Affairs and Sports for guidelines, training academies, research centers, incentive schemes, and integration into national sports policies. This includes games like BGMI, Free Fire, GTA, and Call of Duty played in professional tournaments without monetary stakes. 
  4. Online social and educational games (non-wager-based, age-appropriate) are encouraged, with emphasis on cultural values, skill development, and digital literacy. The Ministry of Electronics and IT (MeitY) and Ministry of Information and Broadcasting will oversee registration and platforms. 
  5. Establishment of Regulatory Body: Creation of a National Online Gaming Authority (or National e-Sports Authority) for oversight, including categorizing games, registering non-money games, issuing guidelines for fair play and compliance, handling complaints, and coordinating with states.  This body will promote growth in e-sports, attract foreign investment, and support job creation. 
  6. Penalties for Violations: Offering or facilitating RMG, Upto 3 years imprisonment and/or ₹1 crore fine. 
  7. Advertising RMG: Up to 2 years imprisonment and/or ₹50 lakh fine. 
  8. Repeat offenses: Enhanced penalties, up to 5 years imprisonment and ₹2 crore fine. Offenses are cognizable and non-bailable. 

 

Potential Impacts

 

  1. Positives : Boosts e-sports legitimacy, potentially leading to more tournaments, sponsorships, and Olympic integration by 2027. Enhances player safety, transparency, and responsible gaming. 
  2. Negatives : Affects India's $3.8 billion gaming industry, impacting companies like Dream11, My11Circle, WinZO, and MPL. Could lead to over 200,000 job losses, decline in ₹25,000 crore foreign investments, ₹20,000 crore annual government revenue loss from GST/taxes, and rise in unregulated offshore platforms. 

The industry has appealed for reprieve, warning of economic disruption.
